For lenders, special servicers and creditors of all stripes, Jon leverages decades of experience, a combination of creativity and pragmatism and a nationwide platform to find solutions to their most intractable and complex challenges arising from distressed situations. Jon possesses a comprehensive knowledge of both the law and the practical realities involved in protecting his clients' interests when defaulting borrowers, customers or debtors put them at risk. With a collegial, professional approach and a reputation among fellow practitioners for firm but fair dealing, Jon crafts efficient resolutions that might elude other attorneys. Jon's clients appreciate his candid counsel and ability to chart a clear path forward on each matter. Jon regularly helps commercial mortgage backed securities (CMBS) special servicers, banks, non-bank lenders, specialty finance companies, businesses and other secured and unsecured creditors enforce their rights and remedies, protect their assets and interests and maximize their recoveries in complex bankruptcy cases, out-of-court loan workouts and business restructurings, mortgage foreclosures, property and equity receiverships, assignments for the benefit of creditors and other troubled situations. Additionally, Jon regularly advises on healthy business deals and financial transactions with these situations in mind, including negotiating and structuring loan agreements, intercreditor and subordination agreements and unitranche "agreements among lenders." With more than 20 years of experience, Jon has also handled all aspects of complex chapter 11 cases for his lender clients in bankruptcy courts across the country, including debtor-in-possession financing, cash collateral disputes, stay relief motions, auctions, asset sales, lease and loan dispositions, plan formation and confirmation, creditor claims and objections, preference actions and fraudulent transfer suits.
