Fred Goldberg’s practice centers on complex commercial litigation, including the defense of consumer claims against financial services companies, real estate litigation, transnational actions and arbitrations, appellate practice, business torts and contract disputes, and the prosecution of and defense against class actions. His litigation and appellate experience includes an emphasis upon personal and subject matter jurisdiction and venue issues. He has successfully represented clients in state and federal courts across the country. During the past several years, his practice has focused upon financial services and mortgage-related litigation involving the defense of claims brought by borrowers and consumers. He has served as lead national counsel for a leading vendor of services and technology in the mortgage industry in the defense of claims relating to the robo-signing of documents in connection with foreclosures. These matters typically involve both common law and statutory causes of action, including RICO, FDCPA, TILA, RESPA, fraud and deceptive trade practices claims relating to the assignment and securitization of mortgages, including claims of wrongful foreclosures and improper charges passed on to borrowers. During the course of this representation, he has secured the dismissal of fourteen class actions, as well as numerous individual claims. He has also defended claims brought by a state attorney general alleging deceptive trade practices and assisted in addressing similar investigations initiated by other authorities.
