A member of the firm’s Commercial Litigation and Compliance, Investigations & White Collar Practice Groups, Kenneth (Casey) Murphy’s primary areas of practice are civil litigation and white collar criminal defense. Although Casey’s focus is trial work, he regularly counsels civil clients on how to resolve litigation pre-suit or pre-trial. Casey’s civil practice encompasses a wide range of claims and actions including the defense and prosecution of a multitude of civil claims, including corporate dissolution and partnership dissolution actions, breach of contract, unjust enrichment, quantum meruit and other commercial tort claims, defense of insurance brokers in negligence actions, defense of disability claims, defense of attorneys and accountants in malpractice suits, negligent hiring and retention actions, breach of fiduciary duty claims, and defense of witnesses and targets in SEC enforcement proceedings. Casey’s criminal practice involves defense of all levels of federal and state prosecutions, including wire fraud, mail fraud, securities fraud, bank fraud, Medicaid/Medicare fraud, money laundering, arson, assault, bribery, and robbery. He has defended corporate officers, police officers, civil servants, and public officials in various criminal prosecutions. Prior to joining Rivkin Radler, Casey practiced in a boutique commercial litigation and white-collar defense firm for 16 years. He was an assistant district attorney in the Bronx County District Attorney’s Office in 1996, where he remained until 2001. In less than two years as an assistant district attorney, Casey was assigned to the Felony Trial Bureau where he prosecuted violent felonies from indictment through trial. He was the youngest assistant district attorney ever assigned to the Major Case Unit and Housing Task Force, where he oversaw complex investigations that included the use of confidential informants, undercover officers, and wiretap surveillance. While attending Binghamton University, Casey was an NCAA Academic All-American in swimming and a recipient of the State University of New York Athletic Conference Jack Fulton Lifetime Achievement Award.
