Eric Fader has represented healthcare providers and other corporate clients in connection with business planning and contractual issues, transactional matters, and federal and state regulatory compliance for more than 35 years. His clients include providers of the technical and professional components of intraoperative neurophysiologic monitoring (IONM) services; telehealth, teletherapy and telepharmacy platform providers; Article 28 licensed diagnostic and treatment centers and ambulatory surgery centers; diagnostic imaging centers; urgent care providers; and private practices of all types. Eric has also represented provider networks, medical device suppliers, equipment vendors, and providers of revenue cycle management and other healthcare services in contractual and regulatory matters. Eric advises on billing and reimbursement questions; federal and state anti-kickback and self-referral issues, and “corporate practice of medicine” and fee-splitting issues in many states; HIPAA compliance (including privacy and data breaches); private payor and Medicare audits and recoupment demands; state licensure and certificate of need matters; and hospital privilege issues. His work also includes organizational matters, corporate governance and structuring/restructuring advice, limited liability company operating agreements, shareholder and partnership agreements and disputes, labor and employment law issues, private securities offerings, joint ventures, mergers and acquisitions. A frequent writer and commentator on healthcare issues, Eric has written for and has been quoted in Bloomberg BNA, Law360 and Thomson Reuters Westlaw, among many others. Eric is the Editor of Rivkin Rounds, “YOUR PRESCRIBED DOSE OF HEALTH LAW NEWS” for businesses, professionals, investors and stakeholders in the healthcare industry. In 2023, he was recognized in the JD Supra Readers’ Choice Awards for the topic of Healthcare.
