J. Alexandra Rhim practices in the areas of commercial finance, loan workouts and debt restructuring, bankruptcy, and creditors’ rights. Her experience involves a wide array of asset-based financing and corporate transactions, commercial and industrial (C&I) loans, and real estate secured loans. Ms. Rhim represents financial institutions, commercial finance companies, creditors, landlords and professional fiduciaries. Secured Lending; Loan Workouts. Ms. Rhim is experienced in addressing troubled debt situations by way of loan workouts and restructuring, forbearance arrangements and other strategic transactions. She also has a “front-end” practice in the documentation of secured loans. Her experience extends to modifying loan facilities, intercreditor matters, and advising of bankruptcy risks at loan origination and afterwards. Bankruptcy Representation. She began the practice of law by specializing in secured creditor representation in bankruptcy cases. She continues to practice in all aspects of bankruptcy including cash collateral, postpetition financing, asset sales, plan confirmation and defense of avoidance actions. She has chartered postpetition financing facilities and exit strategies achieving full repayment for lenders. She also handles litigation and appeals arising from bankruptcy cases. Her noteworthy published cases are: In re Phar-Mor, 301 B.R. 482 (Bankr. N.D. Ohio 2003); Phar-Mor v. McKesson Corp., 534 F.3d 502 (6th Cir. 2008) (landmark decision involving reclamation and postpetition financing); Elliott v. Pacific Western Bank, 969 F.3d 1006 (9th Cir. 2020); and Rubin v. Ross, 2021 WL 2283771 (Cal.App.4th Dist. 2021). Creditors’ Rights; Collateral Recovery. Ms. Rhim also practices in the area of creditor rights with the goal of maximizing client recoveries. Her experience extends to loan enforcement matters and out-of-court proceedings, Article 9 secured creditor remedies, liquidations, assignments for benefit of creditors, and lien priority disputes. She has also successfully resolved disputes through mediation and arbitration.
