Bio

Heidi Gumienny is a partner in the Houston office of Gordon & Rees. Ms. Gumienny is a member of the firm's Appellate, Employment and Labor Law, and Commercial Litigation practice groups. Her practice focuses on state and federal appeals, employment and labor law, municipal liability and complex commercial litigation. Ms. Gumienny has both trial and arbitration experience, has appeared before state and federal courts and has represented clients in administrative proceedings. Ms. Gumienny is board-certified in Civil Appellate Law by the Texas Board of Legal Specialization. Ms. Gumienny has briefed and argued appeals before the Texas Courts of Appeals, the Texas Supreme Court, and the United States Courts of Appeals for the Fifth Circuit and the Sixth Circuit, among other courts. Ms. Gumienny has participated in oral argument before the Houston Courts of Appeals and the Fifth Circuit Court of Appeals. Ms. Gumienny has experience prosecuting and defending interlocutory appeals and mandamus proceedings, as well as traditional appeals of final judgments, and serves as the "appellate monitor" in high-stakes trials. Ms. Gumienny represents public and private employers in litigation in federal and state courts, and in administrative proceedings before the Equal Employment Opportunity Commission, the Texas Workforce Commission and the U.S. Department of Labor, in wrongful termination, discrimination, retaliation, harassment, wage-and-hour, worker’s compensation, restrictive covenants and state whistleblowers protection disputes, both under state and federal law. Ms. Gumienny also counsels clients concerning policies and practices, employee investigations, employee classification, and wage and overtime issues so that client practices and policies conform with state and federal law. Her experience includes drafting employee handbooks and policies and addressing issues related to the hiring, retention, promotion, and firing of employees.
