Bio

Kai Gesing is a partner in the Munich office of Gibson, Dunn & Crutcher. He is a member of the firm’s Antitrust and Competition, Artificial Intelligence and Automated Systems, Intellectual Property, Litigation, Technology Transactions, Privacy and Cybersecurity and White Collar Defense and Investigations practice groups. Mr. Gesing has a wealth of experience in advising clients particularly from technology-driven industries, such as automotive, information technology, security, semiconductor, telecommunications and pharmaceutical companies on complex M&A, licensing and technology transactions and in disputes involving technology, antitrust, intellectual property, data privacy and the legal framework for modern technologies. Mr. Gesing particularly focuses on antitrust and competition law and advises clients in all aspects of European and German antitrust issues, including defense in cartel and other regulatory investigations and court proceedings, antitrust compliance, and merger control proceedings before the German Federal Cartel Office, the European Commission and other international competition authorities. As in previous years, Handelsblatt / The Best Lawyers™ in Germany have recognized Mr. Gesing as one of the best lawyers 2020/2021 for Litigation. The Legal 500 Deutschland 2021 and The Legal 500 EMEA 2021 recommend him for Antitrust and refer to his focus “in German and European antitrust law as well as technology transactions, data protection and cybersecurity.” Mr. Gesing has successfully represented and defended clients in various important national and international litigation and arbitration cases related to antitrust, intellectual property, technology, and other complex commercial law disputes. In addition, Mr. Gesing’s practice has a focus on white collar defense and advice on antitrust compliance , technological compliance, and data privacy compliance (including under the GDPR). He represented and advised clients in a number of high-profile white collar crime investigations in Germany and other European and Asian countries concerning the prevention and detection of, and reaction to, various types of banned business practices such as cartels, fraud, corruption (including the U.S. FCPA and related monitorships), and money laundering . Mr. Gesing is a member of the German association of antitrust professionals (Studienvereinigung Kartellrecht), the German intellectual property association (GRUR) and the German association for data protection and data security (GDD). He speaks German and English.
