Fred’s nationwide practice is divided into business risk management both preventative and post litigation. Having litigated and tried to conclusion cases in virtually every jurisdiction in the nation he is keenly aware of the direct and indirect costs to businesses of improperly planned and managed risk. The vast majority of Fred’s practice deals with businesses operating in federally regulated environments. As such, he focuses on the often conflicting obligations of regulated businesses to disclose adverse events to regulatory agencies and the resulting liability exposure such disclosures cause. He is actively sought out by medical device, pharmaceutical, biotech, and other businesses regulated by FDA to design and manage risk before and after litigation has initiated. He is well-versed in traditional and alternative risk management strategies. Prior to joining FisherBroyles Fred served as the Founding Chair and later Co-Chair of the Life Sciences Practice Group at Fox Rothschild, LLP for more than eleven years. Fred’s risk management expertise includes non-traditional methods of risk management including mediation, arbitration (both domestic and international) captive insurance, reinsurance, managing agent arrangements, surplus lines and fronting arrangements. He serves as panel counsel for several domestic and international insurance carriers and reinsurers after custom-designing and implementing the insurance portion of their risk management strategy. Fred is frequently called upon by his partners and outside attorneys to provide FDA-related advice to litigation teams and risk management plans.
