Begoña Cancino G. Is A Partner In The Mexico City Office. Her Practice Focuses On Intellectual Property, Data Privacy, Regulatory And Administrative Litigation. From the standard IP front, Ms. Cancino counsels clients from all kind of industries with the protection and enforcement of their IP rights in México, assisting also with the transfer of IP portfolios within the context of complex corporate transactions involving all sort of IP rights (such as trademarks, copyrights and appellations of origin), as occurred within the acquisition of Tequila Don Julio by Diageo, where she participated from the revision and drafting of all sort of IP related contracts (i.e. copyright releases, licenses, collaboration, work made for hire and trademark assignments and distribution agreements). Ms. Cancino also provides assistance with her legal advice on regulatory and advertising, assessing our clients to comply with all applicable provisions with COFEPRIS and PROFECO, as occurred within the acquisitions of Quesos La Esmeralda, where she participated in the due diligence providing her advice on the compliance of packages and advertising. Ms. Cancino has represented our clients in all sort of administrative litigation proceedings in general concerning to advertising, health, environmental and of course, IP matters, before administrative authorities (such as the Mexican Institute of Industrial Property, Federal Court for Tax and Administrative Affairs, Federal Consumer Protection Agency, Federal Commission for the Protection against Sanitary Risks, Federal Water Commission, among others) and federal judicial courts (District and Circuit Courts). Pursuant to data privacy aspects, Ms. Cancino has counsel clients from multiple industries in the drafting and implementation of internal policies, privacy notices and specific legal concerns, not only regarding client daily operations, but also within the context of cross border transactions and internal investigations for compliance, where Ms. Cancino has assisted several clients from the pharmaceutical industry within investigations usually related to independent contractors within customs clearance processes. Ms. Cancino has been ranked as Up & Coming by Chambers and Partners since 2017 and has authored the following articles, published by the specialized magazine World Intellectual Property Review: “MCI can look but not touch” and “Protecting Data in Mexico: what you need to know”, as well as published in the 2015 and 2016 editions of the The Data Protection and Privacy Global Guide and IP in business transactions: Mexico overview, a Thomson Reuters publication. Additionally, Ms. Cancino has published in the International Comparative Legal Guides with the Data Chapter for Mexico 2017, the Cybersecurity Chapter for Mexico 2019, as well as the Gambling Chapter for Mexico 2020. Ms. Cancino is a member of the International Trademark Association (INTA), the Mexican Bar Association and the Mexican Association for the Protection of Intellectual Property (AMPPI). Ms. Cancino was born in Tuxtla Gutiérrez, Chiapas, México. She received her law degree (JD) from Universidad La Salle in Mexico City in 2001. She conducted postgraduate studies on Intellectual Property at the Universidad de Buenos Aires (UBA), Universidad Nacional Autónoma de Mexico (UNAM) and the Ilustre Nacional Colegio de Abogados and participated in the Management Program for Lawyers at the Yale School of Management. Ms. Cancino’s native language is Spanish and she is fluent in English.
