Ms. Yuo-Fong “Benni” Amato is a member of the Intellectual Property practice group. She practices in federal courts nationwide, and resides in the Lehigh Valley, Pennsylvania area. Ms. Amato’s practice mainly consists of trademark, cybersquatting, false advertising, copyright, patent, and trade secrets litigation; trademark registrations and portfolio management; licensing agreements; Uniform Domain-Name Dispute-Resolution Policy (“UDRP”) arbitration proceedings; and proceedings before the Trademark Trial and Appeal Board. She has represented both plaintiffs and defendants, ranging from fitness training companies to Internet social publishing companies, and more. In addition to her intellectual property practice, Ms. Amato also has considerable experience with commercial and business contracts, commercial and business litigation (including, for example, defamation and libel litigation and Computer Fraud & Abuse Act litigation), class action litigation, privacy and data security consultations and defense, and professional liability defense. While Ms. Amato’s trial and post-trial experience is extensive, she prides herself in obtaining early victories for clients: In addition to settling cases favorably and early, Ms. Amato has obtained multiple preliminary injunctions against infringers in trademark/patent cases; she has successfully moved to dismiss copyright infringement claims by arguing safe harbor protection under the Digital Millennium Copyright Act; she has also successfully moved to dismiss a group of actresses’ misappropriation of likeness claims under copyright preemption principles.
